Welcome to SPAKL, a service owned and operated by Alpyne 365, LLC (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of the SPAKL mobile application, website, and related services (collectively, the “Service”). By accessing or using SPAKL, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Purpose of the Service

SPAKL is designed to assist users in identifying possible repairs, fixes, and maintenance solutions by providing AI-generated suggestions, instructions, and resources. The Service is for informational and educational purposes only and is not a substitute for professional advice, diagnosis, or services.

2. No Professional Advice

The content provided by SPAKL, whether text, images, or other media, is generated in whole or in part by artificial intelligence (“AI”) and may contain errors, omissions, or inaccuracies.

  • Always consult a qualified professional before attempting any repair, maintenance, or modification.
  • Do not rely solely on SPAKL for making decisions that could result in injury, property damage, or financial loss.
  • You acknowledge that you are solely responsible for evaluating the accuracy, safety, and applicability of any information provided.

3. User Responsibilities

By using SPAKL, you agree to:

  • Exercise reasonable judgment and caution when acting on any information provided.
  • Follow all applicable laws, codes, and safety regulations.
  • Use proper protective equipment and safety procedures when performing any tasks.
  • Immediately discontinue any task if you feel unsafe or unqualified to continue.

4. Assumption of Risk

You acknowledge that repairs, maintenance, and DIY activities inherently carry risks, including but not limited to personal injury, death, property damage, and fire hazards. By using SPAKL, you voluntarily assume all risks associated with such activities.

5. No Warranties

SPAKL is provided “as is” and “as available”, without warranties of any kind, whether express or implied.
We specifically disclaim all warranties, including but not limited to:

  • Accuracy, reliability, or completeness of information.
  • Fitness for a particular purpose.
  • Non-infringement of third-party rights.

6. Limitation of Liability

To the maximum extent permitted by law:

  • SPAKL, its owners, affiliates, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Service.
  • This includes damages for injury, loss of life, property damage, or financial loss resulting from any information, instructions, or recommendations provided by the Service.

7. Indemnification

You agree to indemnify, defend, and hold harmless SPAKL, its owners, affiliates, employees, and agents from and against all claims, liabilities, damages, losses, or expenses (including attorneys’ fees) arising out of or related to your use of the Service, violation of these Terms, or violation of any rights of another person or entity.

The Service may include links to third-party websites or content. We do not endorse, control, or assume responsibility for such content. You access third-party resources at your own risk.

9. Subscriptions and Payments

SPAKL may offer subscription plans or in-app purchases to access certain features.
All purchases and billing are managed through the Apple App Store or Google Play Store,
and their respective terms, policies, and payment systems apply.
We do not process or store payment information directly.

Subscriptions are personal, non-transferable, and licensed solely to the individual account holder.
You may not share, sell, or otherwise allow others to access the Service using your account or subscription.
Unauthorized sharing of login credentials or access may result in suspension or termination of your account without refund.

10. Termination

We may suspend or terminate your access to SPAKL at any time, without notice, if we believe you have violated these Terms, engaged in harmful behavior, or misused the Service.

11. Modifications to the Service

We may modify, suspend, or discontinue any part of the Service at any time without notice. We are not liable for any resulting effects of such changes.

12. Governing Law

These Terms are governed by and construed under the laws of the State of Pennsylvania, without regard to its conflict of laws principles.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
